I was not a client of this firm, but was on the opposing side of a property transaction in which this solicitor acted for the buyer. I am leaving this review because the conduct I observed over a seven month period gave me significant cause for concern, and I believe others should be aware.
Some of the issues noted during the transaction include:
• Basic spelling errors were present in correspondence we saw — 'there' was used consistently to denote ownership, as in 'there property.' For a profession in which precision of language is fundamental, this was not a reassuring introduction.
• A document was submitted that was subsequently identified as identical to one already in the process, presented as an alteration. The management company later confirmed that this had caused delay, citing confusion over a submitted change that contained no changes.
• Significant concern was expressed over a hypothetical increase in service charge. Simple arithmetic would have demonstrated that an increase to five times the current figure (~£250 per year, having not materially changed in 7 years) would still have resulted in a charge of approximately £100 per month — comfortably affordable at the price point of this transaction. While the resulting extended delay was not directly their responsibility, it arose solely as a consequence of an objection that did not appear to reflect a proportionate assessment of actual risk.
• A concern was raised regarding the management company directorship — specifically, it appeared to be assumed that, as one of the vendors was a director of the estate management company, the sale would result in no remaining director, resulting in a significant problem that was not shared with us. This information was publicly available from the outset and would have revealed that a second director remained in place, rendering the concern entirely moot. This was the final item raised before the buyer withdrew from the sale.
The cumulative effect of these issues was a transaction that ran for seven months before ultimately collapsing, by which point we had promptly, and in good faith, met all the costs of addressing each of their concerns. The withdrawal came only after all of that had been completed — and if the directorship concern was indeed the final reason, as the timing suggests, it is one that could have been raised, and resolved, on day one. The reason for withdrawal has, two weeks later, not been formally confirmed, as our solicitor's request for clarification remains unanswered.
